§ 3. Participation in the Program
- Participation in the Program is voluntary and free of charge.
- Only the Account holder may participate in the Program. Guest purchases are not covered by the Program and do not result in Points being awarded.
- Participation in the Program begins when the Account is created. No separate registration is required.
- The Program is intended for individuals. The Seller may refuse participation in the Program to entities making purchases for resale.
- The Participant may withdraw from the Program at any time by sending a statement to shop@fajneciuchy24.pl. Withdrawal stops the accrual of further Points and does not affect the Account or orders already placed. Points collected up to the date of withdrawal remain valid and may be used under the existing rules. The Participant may resume participation in the Program at any time.
§ 4. Earning Points
- The Participant receives 1 Point for every full PLN 10 of the price of Goods in a paid and completed order.
- The basis for calculating Points is the price of the Goods actually paid - after discounts have been applied and the amount covered by Points has been deducted. Delivery costs and other additional fees are not included in the basis.
- Points are calculated down to the nearest whole Point. An amount below PLN 10 does not earn a Point and is not carried over to the next order.
- Points are added to the balance when the shipment is dispatched, and for personal pickup - when the Goods are handed over to the Participant.
- In addition to purchases, the Participant receives a one-time:
- 10 Points for creating an Account,
- 10 Points for subscribing to the Newsletter and confirming the subscription in accordance with the Newsletter Terms and Conditions.
- The bonuses referred to in section 5 are granted once per Participant, regardless of the number of Accounts created and subscriptions made.
- Unsubscribing from the Newsletter does not result in the loss of Points already awarded for subscribing to it. The Participant may withdraw their marketing consent at any time without any consequences for their Points balance.
- The Seller may award additional Points as part of promotional campaigns. The rules and duration of such a campaign will be provided by the Seller when it is announced.
§ 5. Using Points
- 1 Point corresponds to PLN 0.50 off the price of purchases in the Store.
- Points can be used only when placing an order in the Store, by specifying the number of Points to be used in the order summary.
- There is no minimum number of Points or minimum order value. Points can be used starting with the first Point collected.
- Points can be used to cover the price of Goods. Points cannot be used to cover delivery costs.
- Points can be combined with discounts and promotions available in the Store, unless the Seller has expressly stated otherwise in the announcement of a given promotion.
- Using Points reduces the amount payable. The discount amount is shown in the order summary before the order is placed.
- Points used in an order are deducted from the balance when the order is placed.
§ 6. Points balance and validity
- The Participant can check the current Points balance after logging in to the Account and in the order summary.
- Points are valid indefinitely as long as the agreement for maintaining the Account remains in force.
- Points expire upon termination of the agreement for maintaining the Account - regardless of whether the Account is deleted by the Participant or the Seller. Before deleting an inactive Account, the Seller informs the Participant and provides the Points balance, in accordance with § 5 of the Store Terms and Conditions.
- The expiry of Points does not apply to funds corresponding to payments made by the Participant - in particular, funds from a price refund recorded as store credit. These are refunded under the terms described in the Store Terms and Conditions.
- Points are assigned to the Account. They cannot be transferred to another person, sold, or combined across multiple Accounts.
§ 7. Returns of Goods and Points
- In the event of withdrawal from the contract, return of the Goods, or acceptance of a complaint, the Seller deducts from the balance the Points awarded for the returned Goods.
- If the Participant's balance is insufficient to cover the Points deducted, the Seller will not pursue the shortfall. The balance may not become negative.
- Points used to reduce the price of the returned Goods are immediately credited back to the Participant's balance, no later than within 14 days of receipt of the withdrawal statement or of the complaint being accepted.
- The portion of the price covered by Points is returned to the balance in Points. The amount actually paid in money is refunded in money, in accordance with Article 32 of the Consumer Rights Act and under the terms set out in the Store Terms and Conditions.
- The provisions of this section do not limit the Participant's rights arising from the right of withdrawal or from a lack of conformity of the Goods with the contract.
§ 8. Legal nature of Points
- Points constitute an entitlement to reduce the price of purchases in the Store under the terms described in the Terms and Conditions.
- Points are not electronic money within the meaning of the Payment Services Act, nor are they a payment instrument.
- Points cannot be exchanged for cash or any other monetary benefit and do not accrue interest.
- Points do not constitute a monetary claim against the Seller and may not be traded.
§ 9. Abuse
- Use of the Program in a manner contrary to its purpose is prohibited, in particular:
- creating more than one Account by the same person in order to claim the bonuses from § 4(5) multiple times,
- placing orders in an automated or sham manner, without the intention of purchasing the Goods,
- using software that automates purchases or registration.
- The Participant's mere exercise of the right to withdraw from an agreement, the right to return Goods or the right to submit a complaint never constitutes abuse and may not constitute grounds for cancelling Points or exclusion from the Program - regardless of the number of such events.
- If abuse is identified, the Seller may cancel the Points obtained as a result and exclude the Participant from the Program.
- Before cancelling Points or excluding a Participant, the Seller will notify the Participant by email, stating the reason, and give them 14 days to respond. The Seller will make a decision after considering the Participant's explanations.
- The cancellation of Points does not include Points awarded for orders that were actually completed and not returned.
- Exclusion from the Program does not affect the agreement for maintaining the Account or orders already placed.
§ 10. Complaints concerning the Program
- Complaints concerning the Program - in particular, failure to award Points, an incorrect balance or problems with using them - should be sent to shop@fajneciuchy24.pl.
- The report should include the email address assigned to the Account, the number of the order concerned and a description of the irregularity.
- The Seller will respond to a complaint within 14 days of receiving it and provide the response to the Consumer on paper or another durable medium. Failure to respond within this period means that the complaint is deemed accepted.
- Out-of-court methods of handling complaints and pursuing claims are governed by § 14 of the Store Terms and Conditions.
§ 11. Personal data
- The Seller is the controller of the Participants' personal data.
- As part of the Program, Account data and order data necessary for awarding and settling Points are processed.
- The processing is based on the performance of the agreement for participation in the Program (Article 6(1)(b) of the GDPR) and the Seller's legitimate interest in establishing, pursuing or defending claims and preventing abuse (Article 6(1)(f) of the GDPR).
- Detailed information on data processing - including recipients, retention periods and the rights available to you - is provided in the Privacy Policy.
- Participation in the Program does not involve making decisions concerning the Participant based solely on automated processing that would produce legal effects concerning them or similarly significantly affect them (Article 22 of the GDPR).
§ 12. Amendments to the Terms and Conditions and termination of the Program
- The Seller may amend the Terms and Conditions only for important reasons, namely:
- a change in the law or the need to adapt the Terms and Conditions to court rulings or decisions of administrative authorities,
- a change of the provider or IT tool supporting the Program,
- a change in market conditions or the costs of operating the Program justifying a change to the rules for awarding Points in the future,
- security considerations or the prevention of abuse,
- technical or organisational changes on the Seller’s part that directly affect how the Program is operated.
- The Seller shall notify Participants of any amendment to the Terms and Conditions by email, sending the amended Terms and Conditions in a form that enables them to be stored and reproduced, at least 14 days before the amendment enters into force.
- A Participant who does not accept the change may withdraw from the Program before it enters into force. An amendment to the Terms and Conditions may not deprive a Participant of Points collected before it enters into force or reduce their value.
- The Seller may end the Program for important reasons by notifying Participants by email at least 3 months before the end date.
- Until the Program ends, a Participant may use the collected Points under the existing rules. Points not used by that date shall expire.
- The Seller makes previous versions of the Terms and Conditions available in the Shop, together with the periods during which they were in force.
- Transitional provision. These Terms and Conditions are the first document to organise the rules of the Program previously operated under the terms announced in the Shop. Points collected before 24 August 2026 remain fully valid and may be used in accordance with these Terms and Conditions. For Participants who took part in the Program before that date, these Terms and Conditions shall enter into force 14 days after they are notified by email, in accordance with paragraphs 2 and 3.
§ 13. Final provisions
- Participation in the Program takes place in Polish.
- The Terms and Conditions are made available free of charge in the Shop in a form that enables their retrieval, reproduction and storage.
- In matters not regulated by these Terms and Conditions, the Shop Terms and Conditions and the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
- The choice of Polish law does not deprive a Consumer whose habitual residence is in another country of the protection afforded by the mandatory provisions of that country’s law (Article 6(2) of Regulation (EC) No 593/2008 - Rome I).
- The Seller does not apply any code of good practice within the meaning of Article 2(5) of the Act on Counteracting Unfair Market Practices.
- In disputes with a Participant who is neither a Consumer nor a natural person concluding a contract directly related to their business activity, which does not have a professional nature for them, the competent court is the court having jurisdiction over the Seller’s registered office.
