§ 3. Technical requirements

  1. To use the Newsletter, you need a device with internet access, an active email account, and an up-to-date web browser.
  2. Handling cookies necessary for the sign-up form to function is required to sign up for the Newsletter.
  3. The Service Provider informs users about the risks associated with using email, in particular the possibility of receiving messages impersonating the Store. The Service Provider never asks for a password or payment card details in its messages.

§ 4. Signing up for the Newsletter and concluding the agreement

  1. Using the Newsletter is voluntary and free of charge. It is not a condition for placing an order or creating an Account in the Store.
  2. Sign-up takes place in two steps:
    • Step 1. The User enters an email address in the sign-up form available in the Store and confirms their wish to receive the Newsletter.
    • Step 2. The Service Provider sends a message with a confirmation link to the provided address. Clicking the link completes the sign-up process.
  3. The agreement for the provision of the Newsletter service is concluded when the confirmation link referred to in section 2 is clicked. Until then, the Service Provider does not send any marketing messages to the provided address.
  4. If the confirmation link is not clicked, the email address is not added to the Newsletter, and the Service Provider deletes it from the mailing system.
  5. The two-step sign-up process protects against an unauthorized person subscribing someone else’s address and at the same time constitutes proof of consent referred to in Article 398 of the Electronic Communications Law.
  6. The agreement is concluded for an indefinite period.
  7. Providing a valid email address is necessary to provide the service. The User provides only an address they are authorized to use.
  8. Signing up for the Newsletter may involve a welcome discount. The Service Provider provides its terms - including the amount, validity period, and any exclusions - in the message containing the discount code and next to the sign-up form.

§ 5. What we send as part of the Newsletter

  1. As part of the Newsletter, the Service Provider sends:
    • messages sent periodically - information about new arrivals, promotions, sales, and the Store’s range,
    • automated messages triggered by the User’s activity in the Store - in particular, reminders about products left in the cart, reminders about viewed products, welcome messages, and messages sent to people who have not visited the Store for a long time.
  2. Consent to the Newsletter covers both types of messages indicated in paragraph 1. Unsubscribing from the Newsletter stops the sending of all such messages.
  3. The Newsletter does not include messages necessary to perform a sales agreement or an agreement for maintaining an Account - such as an order confirmation, shipping information, a response to a complaint, or a notification of a change to the Terms. The Service Provider sends these messages independently of Newsletter subscription, and they cannot be unsubscribed from without terminating the agreement to which they relate.
  4. The Service Provider does not specify the sending frequency in advance. The Newsletter is sent as information referred to in paragraph 1 becomes available.
  5. Content selection. The content of messages may be tailored to the Service User based on their activity in the Store - products viewed, cart contents, order history, and responses to previous messages. This constitutes profiling within the meaning of Article 4(4) of the GDPR.
  6. The profiling referred to in paragraph 5 does not produce legal effects concerning the Service User or similarly significantly affect their situation (Article 22 of the GDPR). In particular, it does not affect prices in the Store - under the Store Terms, the price of a product is the same for all buyers, and the Service Provider does not use individualized pricing.
  7. The Service User may, at any time and without giving a reason, withdraw consent to receive the Newsletter (Article 7(3) of the GDPR), in the manner described in § 6. To the extent that the data is processed on the basis of the Service Provider’s legitimate interest, the Service User also has the right to object to processing for direct marketing purposes, including profiling for this purpose (Article 21(2) of the GDPR).
  8. The Newsletter is sent exclusively by email. The sending of SMS messages or web push notifications is not covered by these Terms and requires separate prior consent.
  9. The Service Provider does not sell or disclose Service Users’ email addresses to other entities for marketing purposes.

§ 6. Unsubscribing and withdrawing consent

  1. The Service User may unsubscribe from the Newsletter at any time, without giving a reason and without incurring any costs.
  2. Unsubscribing is done by:
    • clicking the “Unsubscribe” link included in the footer of every message, or
    • sending a statement to the address shop@fajneciuchy24.pl.
  3. Unsubscribing is equivalent to withdrawing the consent referred to in Article 398 of the Electronic Communications Law and consent to the processing of data for direct marketing purposes.
  4. Unsubscribing results in the immediate termination of the agreement for the provision of the Newsletter service. Sending shall be stopped immediately, no later than within 24 hours. If the Service Recipient receives a marketing message despite unsubscribing, this does not in any way limit their rights - please report this to shop@fajneciuchy24.pl.
  5. Withdrawal of consent does not affect the lawfulness of sending carried out before the withdrawal was submitted (Article 7(3) of the GDPR).
  6. Unsubscribing from the Newsletter does not delete the Account in the Store or affect placed orders.
  7. The Service Provider may terminate the agreement for the provision of the Newsletter service with a 14-day notice period if it ceases to provide this service or if the Service Recipient uses it in a manner that violates the law. The termination notice shall be sent to the Service Recipient's email address.

§ 7. Right of withdrawal

  1. The Privileged Service Recipient has the right to withdraw from the agreement for the provision of the Newsletter service within 14 days of its conclusion, without giving any reason.
  2. The withdrawal statement may be sent to shop@fajneciuchy24.pl. To meet the deadline, it is sufficient to send the statement before it expires.
  3. The Privileged Service Recipient may use the model withdrawal form constituting Annex 2 to the Consumer Rights Act, but this is not mandatory - a clear statement is sufficient.
  4. The service is free of charge, so withdrawal does not involve any settlements or costs for the Service Recipient.
  5. The Service Recipient does not have to wait for this period to expire or invoke it - the cancellation described in § 6 is available at any time and produces the same effect, and is simpler.

§ 8. Complaints

  1. Complaints concerning the Newsletter - in particular, failure to receive messages, receiving them despite unsubscribing, or errors in their content - should be sent to shop@fajneciuchy24.pl.
  2. The report should include the email address concerned and a description of the irregularity.
  3. The Service Provider shall respond to a complaint within 14 days of receiving it and provide the response to the Privileged Service Recipient on paper or another durable medium. Failure to respond within this period means that the complaint is deemed accepted.
  4. The Service Provider shall be liable to the Privileged Service Recipient for the Newsletter's conformity with the agreement under the principles set out in Chapter 5b of the Consumer Rights Act, insofar as those provisions apply to digital services supplied in exchange for personal data.

§ 9. Out-of-court dispute resolution

  1. The Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular:
    • apply to the voivodeship inspector of the Trade Inspection Authority to initiate mediation proceedings,
    • apply to a permanent arbitration court operating at the voivodeship inspector of the Trade Inspection Authority to resolve the dispute,
    • seek free assistance from a county or municipal consumer ombudsman,
    • seek assistance from a social organization whose statutory objectives include consumer protection.
  2. A list of entities authorized to conduct out-of-court consumer dispute resolution is maintained by the President of the Office of Competition and Consumer Protection and is available at uokik.gov.pl.
  3. Mediation before the voivodeship inspector of the Trade Inspection Authority and proceedings before a permanent arbitration court are voluntary and require the consent of both parties to the dispute. Seeking assistance from a consumer ombudsman or a social organization does not require the Service Provider's consent.
  4. The Service Provider has not undertaken to use out-of-court consumer dispute resolution. The Service Provider informs the Consumer on a durable medium whether it agrees or does not agree to participate in such proceedings in response to a complaint, if the complaint has not been accepted.

§ 10. Personal Data

  1. The controller of the Service Recipients' personal data is the Service Provider.
  2. As part of the Newsletter, the email address is processed, as well as - if the Service Recipient uses the Store - data concerning their activity referred to in § 5(5).
  3. The legal basis for processing is consent (Article 6(1)(a) of the GDPR in conjunction with Article 398 of the Electronic Communications Law), while the obligation to demonstrate that consent was given and withdrawn is based on a legal obligation and the Service Provider's legitimate interest (Article 6(1)(c) and (f) of the GDPR).
  4. Detailed information on data processing - including recipients, retention periods, transfers outside the European Economic Area, and the rights to which you are entitled - is provided in the Privacy Policy, while information about cookies is provided in the Cookie Policy.
  5. Providing an email address is voluntary, but necessary to provide the service. Without it, the Newsletter cannot be sent.
  6. The Service Recipient may withdraw their consent at any time in accordance with the rules described in § 6 and lodge a complaint with the President of the Personal Data Protection Office.

§ 11. Amendments to the Terms and Conditions

  1. The Service Provider may amend the Terms and Conditions only for important reasons, namely:
    • a change in legal regulations or the need to adapt the Terms and Conditions to court rulings or decisions of administrative authorities,
    • a change in the scope or manner of providing the Newsletter or a change of the mailing system provider,
    • security considerations or prevention of abuse,
    • technical or organisational changes on the Service Provider’s part that directly affect how the Newsletter is provided.
  2. The Service Provider informs Service Recipients of amendments to the Terms and Conditions by email, sending the text of the amended Terms and Conditions in a manner enabling them to be stored and reproduced, at least 14 days before the amendment enters into force.
  3. A Service Recipient who does not accept the amendment may unsubscribe from the Newsletter before the date it enters into force, without incurring any costs – in the manner described in § 6. Failure to unsubscribe constitutes acceptance of the amended Terms and Conditions.
  4. The Service Provider makes previous versions of the Terms and Conditions available in the Store, together with the periods during which they were in force.
  5. Transitional provision. The Terms and Conditions in the wording of 24 August 2026 apply to agreements for the provision of the Newsletter service concluded from that date. For persons subscribed to the Newsletter before that date, the amendment enters into force 14 days after the date on which they are notified by email, in accordance with paragraphs 2 and 3; until then, the previous Newsletter Terms and Conditions apply.
  6. Persons subscribed to the Newsletter before 24 August 2026 remain subscribed. The two-step subscription referred to in § 4(2) applies to subscriptions made from that date.

§ 12. Final provisions

  1. The agreement for the provision of the Newsletter service is concluded in Polish.
  2. The Terms and Conditions are made available free of charge in the Store before the conclusion of the agreement, in a manner enabling their retrieval, reproduction, and recording.
  3. The Service Recipient is prohibited from providing unlawful content.
  4. Matters not regulated by the Terms and Conditions are governed by Polish law, in particular the Civil Code, the Consumer Rights Act, the Act on Providing Services by Electronic Means, and the Act – Electronic Communications Law.
  5. The choice of Polish law does not deprive a Consumer whose habitual residence is in another country of the protection afforded by the mandatory provisions of the law of that country (Article 6(2) of Regulation (EC) No 593/2008 – Rome I).
  6. The Service Provider does not apply a code of good practices within the meaning of Article 2(5) of the Act on Counteracting Unfair Market Practices.
  7. In a dispute with a Service Recipient who is not a privileged Service Recipient, the competent court is the court having jurisdiction over the Service Provider’s registered office.
